Public office is a public trust. When you ran for a seat in the Law Student Government, you simultaneously and irrevocably bound yourself to serve the student body to the best of your ability. “Service” means putting your constituents’ interests before yours, not the other way around.

Thanks to Loraine, I suddenly remembered that I have a Tumblr account. Which I have neglected for 2 (or more) years. Which I plan to resurrect in time for my senior year in law school. So help me God.

P.S. Today, the Senate of the Philippines convicted the Chief Justice of the Supreme Court in relation to Art. II of the Articles of Impeachment. This is a first in Philippine history.

  • Mark: hi eden
  • Me: hi mark
  • Mark: kumusta review nyo
  • Me: hindi pa nagsisimula
  • Mark: sayang wala ako dyan huhu
  • Me: may 3 cases pa ako dapat idigest. eh madami ka naman na alam sa consti eh :))
  • Mark: madami ka dayn
  • Mark: mababa nga grade ko
  • Me: wushu
  • Mark: wushu ka dyan
  • Mark: hehe
  • Mark: ano bang case ang nakaasign ka?
  • Me: ang hindi ko na lang nababasa
  • Me: osmena vs. pendatun, jimenez vs. cabangbang, puyat vs. de guzman
  • Me: ung mga naunang cases, about qualifications ng members of the hor
  • Me: residence, property
  • Mark: i think i kno pendantum
  • Mark: clue
  • Me: tas ang binabasa ko ngayon, compensation and privileges
  • Mark: galing naman
  • Me: nge
  • Me: inassign lang sakin un eh
  • Mark: galing
  • Mark: question
  • Mark: ni sir
  • Me: anu?
  • Mark: can, d congress increase the qualifications of members of the bar?
  • Mark: sorry of hor hindi bar
  • Me: no
  • Mark: really?
  • Mark: hehe
  • Me: qualifications to get elected as member of the hor are determined by the constitution
  • Mark: defend ur answer ha?
  • Me: congress has no power to add qualifications
  • Me: for 2 main reasons
  • Mark: mayron bang qualifiaction na must be a registered voter?
  • Mark: yes or no?
  • Me: wala
  • Me: but must be a resident of the district for at least a year before the elections
  • Mark: meron kaya, pls check d codal
  • Me: codal?!
  • Mark: i mean d consti codal
  • Me: or meron ba
  • Me: okok
  • Me: sige meron :))
  • Mark: di i check mo muna
  • Me: andaya naman! residence at property pa lang nababasa ko
  • Mark: naku, isang article lang naman un
  • Me: teka
  • Me: uu
  • Me: hindi ko binasa ung article :))
  • Me: cases lang
  • Me: anyway
  • Me: yeah, dapat registered voter
  • Mark: so meron?
  • Me: uu
  • Mark: see
  • Mark: so if u check article 5 on suffrage
  • Mark: section 1
  • Me: oh
  • Mark: suffrage may be exercised by citizens not otherwise disqualified by law...
  • Me: uu
  • Mark: so, indirectly congress can add qualifications using the rubric on th registered voter
  • Mark: tama?
  • Mark: bos?
  • Me: hmm
  • Me: pwede?
  • Mark: wat do u think?
  • Mark: wel d gen rule is they cannot
  • Me: feeling ko hindi
  • Me: see!
  • Me: niloloko mo lang ako :|
  • Mark: but if u weave provisions they can directly add
  • Mark: i mean indirectly
  • Mark: add
  • Mark: oi, di kita niloloko
  • Me: errr
  • Me: tingin ko
  • Mark: ano?
  • Me: hindi ba ang ibig sabihin ng "not otherwise disqualified by law"
  • Me: is yung incapacity?
  • Me: like civil interdiction
  • Mark: w/c is by the way a congressionional imposition
  • Me: which outdates the present constitution
  • Mark: so, what prevents congress from adding to that list
  • Me: the rpc was enacted 1930
  • Mark: but then again
  • Mark: this are congressional creations
  • Me: kaya nga
  • Mark: they can be repaeled at will by congress
  • Mark: unless prohibited by constu
  • Mark: so back to my point
  • Mark: can congress add the qualifications
  • Me: pero
  • Mark: generally no, but indirectly they can
  • Me: hindi ba what cannot be directly done
  • Me: can neither be done indirectly?
  • Mark: yah, dats a good point
  • Me: otherwise, it would defeat the very essence of the constitutional provision
  • Mark: really, explicit ba na they cannot
  • Me: Section 6. No person shall be a Member of the House of Representatives unless he is a natural-born citizen of the Philippines and, on the day of the election, is at least twenty-five years of age, able to read and write, and, except the party-list representatives, a registered voter in the district in which he shall be elected, and a resident thereof for a period of not less than one year immediately preceding the day of the election.
  • Me: hmm
  • Me: wala ngang explicit prohibition
  • Mark: kaya, they can actually by adding disqualificaions for suffrage, it so happens that a registered voter is a qualification
  • Me: pero, if we take into consideration the political system enshrined in our constitution
  • Me: as well as the principle of social justice underlying it
  • Mark: oh ganito na lang. from the list provided they cannot. NO EXEMPTION
  • Mark: but isang qualification ay registered voter w/c cud be manipulated by congress
  • Me: you cannot easily prevent citizens from exercising their right to suffrage
  • Mark: yes, unless disqualified by law
  • Me: yes, disqualifications cannot be lightly enacted
  • Me: so my answer would be
  • Me: generally yes
  • Mark: fine with me.hehe
  • Mark: but theoretically they cud manipulte the registered voter thing
  • Me: but in the very rare instances that congress can overcome the burden of proving that additional disqualifications are justified, then yes
  • Me: pero i think the chances are very slim
  • Me: as an elective official, you want to have as many voters as possible
  • Mark: but theoretically?
  • Me: disqualifying more people can mean losing more votes
  • Mark: dats policy considerations
  • Mark: but theoretically?
  • Me: which will ALWAYS be taken into consideration
  • Me: hmm
  • Me: theoretically
  • Me: yes with the slightest probability
  • Me: stress on the slightest
  • Mark: oo na. well cgi na nga. but i have support from references see bernas
  • Me: because the SC will still have to determine W/N the additional disqualifications are called for
  • Mark: hehe
  • Me: Bernas has lost my confidence
  • Me: :))
  • Mark: hmm, his good in political law
  • Mark: hmm, his good in political law
  • Mark: tapos i find merit in his assertion
  • Me: so how come he can't answer the question: W/N GMA can appoint a new CJ, correctly?
  • Mark: looking d provision on qualifications and dat on suffrage
  • Mark: its preganant with political issues
  • Mark: hehe
  • Me: haha
  • Mark: but i really encourage you to compare the 2 provisions. he has a point
  • Me: hmph sige na nga
